Terms of Service
1. General
1. WhatIBuy (whatibuy.dk and the WhatIBuy app) is an online consumer service owned and operated by Kauza ApS, CVR no. 41024216, with registered office at Rosenborggade 17, 4th floor, 1130 Copenhagen K.
2. These terms of service apply to the WhatIBuy app and associated services and platforms such as www.whatibuy.dk (hereinafter referred to as ”WhatIBuy”)
3. It is a condition for the use of WhatIBuy that these terms of service (“the agreement” or “the terms”) are accepted.
4. WhatIBuy may only be used by individuals aged 18 or older who have accepted these terms of service.
5. Kauza makes WhatIBuy available to the user with the content available at any given time. Kauza may change the content or functionality of these services without prior notice to the users.
6. For information on how Kauza processes your personal data, please refer to WhatIBuy’s privacy policy.
2. The Service
1. WhatIBuy is a service that, with the users’ express consent, gives users an overview of their grocery spending by collecting grocery receipts from different stores in one place. Users themselves decide which grocery stores they wish to connect in the app. Each time a user wishes to connect a grocery store to the service, the user will be asked to give consent for WhatIBuy to collect receipts from the store in question. On this basis, WhatIBuy gives users the opportunity to access a range of insights and the following features:
2. The ”Budget feature” makes it possible for the user to set a monthly budget target for the user’s grocery spending. WhatIBuy tracks the user’s spending and presents it in an overview, allowing the user to monitor whether they are staying within their budget.
3. The ”Spending feature” makes it possible for the user to get an overview of which categories money is spent on in the grocery stores covered.
4. In the ”Compare feature”, the user can keep track of what proportion of the user’s spending is on organic products and see this in relation to the average for all other users of WhatIBuy. In the ”Compare feature”, it is likewise possible to compare one’s spending across categories with the average of all other users in WhatIBuy.
5. In the ”Stores feature”, WhatIBuy displays an overview of which stores the user has shopped at, how much they have spent, how often they have shopped there, and their average spend. In the stores feature, it is also possible to see the contents of each individual receipt.
6. Kauza conveys information from third parties (“third parties”) as part of the Service. Kauza is not responsible for the accuracy of information from third parties’ services (“third-party service”) and assumes no liability for such information or services.
7. The Service is subject to your acceptance of and compliance with the terms of this agreement. When you create a user account for use of the Service, this constitutes your acceptance of the agreement, whereby you enter into a binding contract between you and Kauza. Before you do so, you must read and accept all the terms and conditions contained in these terms and in any associated documents. See the appendices Privacy Policy and Cookie Policy. The agreement is available on WhatIBuy’s website www.whatibuy.dk and is concluded in Danish.
8. As long as you comply with the terms of this agreement and all incorporated documents, Kauza hereby grants you a limited, revocable, non-transferable and non-exclusive right to use the Service. No rights that are not explicitly stated are granted to you.
9. Kauza reserves the right at any time to change or discontinue the Service, temporarily or permanently, or parts thereof with or without notice.
3. Creation of a profile
1. To use WhatIBuy you must create a profile. Creating a profile requires that you provide your email address and a password. The profile you create is for your own personal use.
2. To get the full benefit of all features in WhatIBuy you may provide a number of additional details about yourself, such as postcode, number of people in your household, age, gender, etc.
3. When creating a profile with WhatIBuy you must enter a personal password, which should be treated as confidential.
4. Security
1. WhatIBuy complies at all times with at least the following security requirements:
1. All data communicated back and forth between WhatIBuy and your device is encrypted. It is therefore not possible for outsiders to access the content of the data stream between you and WhatIBuy.
2. Only authorised employees at Kauza and our development partner Reload A/S have, for the purpose of ensuring data quality and troubleshooting, access to production data without further consent.
3. Kauza regularly backs up all data in WhatIBuy.
4. WhatIBuy logs, among other things, the IP addresses from which your profile is accessed. This logging takes place through Cloud Functions for Firebase processes, which temporarily store the user’s IP addresses. 5. You are responsible for keeping your password confidential.
2. In the event of misuse or suspicion of misuse of your password you must immediately notify Kauza by contacting the above address or contacting us at info@whatibuy.dk. If Kauza suspects misuse of your profile, we may at any time block your profile. In such circumstances, Kauza shall not be liable to you or any third party.
3. If you change your password or login details on third-party services you lose access to receipts from the third party in question until you update your login via WhatIBuy.
4. Kauza assumes no responsibility for the user’s compliance with third-party terms.
5. WhatIBuy recommends that you as a user maintain a high security standard. You should:
1. Ensure that your password is always sufficiently secure. It should, among other things, contain special characters.
2. You should never give others access to your password.
5. Collection of data from other digital services
1. With your express consent, Kauza may, for the purpose of your use of WhatIBuy, obtain information from third parties that store digital receipts. Only information contained in your receipts is obtained. For further information, please refer to WhatIBuy’s privacy policy.
2. Kauza may via WhatIBuy obtain data from selected providers of digital receipts, but cannot guarantee that data can be obtained from all providers of digital receipts. Kauza has sole discretion over which providers it retrieves data from.
6. Communication between WhatIBuy and the user
1. WhatIBuy may from time to time provide you with important information, e.g. about changes to these terms, via the email address you provide in connection with creating your profile and/or via push notifications in the WhatIBuy app.
2. When you create a profile with WhatIBuy, you agree to receive push notifications in the WhatIBuy app. WhatIBuy’s communications may be based on information about your spending. You can see more about how Kauza handles your personal data in WhatIBuy’s privacy policy.
3. WhatIBuy gives you access in the WhatIBuy app to an overview of your spending. The overview may be spending summaries, updates on your spending goals and similar information.
4. When creating your profile, you may give consent for WhatIBuy to send newsletters, information about new features and other material concerning WhatIBuy to your email address and/or via push notifications in the app.
7. Rights
1. All content and materials displayed on WhatIBuy, including but not limited to text, layout (e.g. graphics, logos, names, design, page headings, button icons, scripts and service names) and sound, are protected by intellectual property rights or proprietary rights and belong either to Kauza or to a third party with which Kauza has entered into an agreement. You may not use the above for any purpose other than as stated in this agreement.
2. Kauza holds all rights to its Services, including the WhatIBuy app, and all other material on WhatIBuy. This includes, but is not limited to, copyrights, proprietary rights and trademark rights to WhatIBuy.
3. You retain the rights to material you upload to WhatIBuy but grant WhatIBuy a non-exclusive right of use to this material, so that Kauza can deliver its Services to you and to our third parties.
4. As a user you receive a non-exclusive right of use to WhatIBuy. Kauza may at any time revoke this right of use.
8. Operation and maintenance
1. Kauza endeavours to prevent errors, defects and service disruptions in WhatIBuy, but cannot guarantee that they will not occur. Kauza is happy to receive information about such matters and will seek to remedy them as soon as reasonably possible; all contact is made by writing to info@whatibuy.dk
2. Kauza regularly carries out maintenance and updates of the WhatIBuy app. In connection with maintenance, certain or all features may become temporarily unavailable. In connection with updates, one or more features may be removed from WhatIBuy.
3. Kauza will, to the extent possible, provide advance notice of expected service disruptions in WhatIBuy, and will similarly seek to inform users of any removal of features, but is not obliged to do so.
4. Kauza is in no way liable to its users in the event of errors, defects, operational disruptions or removal of functionality.
9. Termination
1. If you disagree with the terms of service or for another reason no longer wish to use WhatIBuy, you may at any time delete your profile. When you delete your profile, all your data is anonymised. We delete your password and username. Your receipt data will not be deleted, but will no longer be able to be linked to your user and will thus be anonymous.
2. Kauza may at any time and without notice suspend or terminate your agreement to use WhatIBuy and possibly delete your user profile, e.g. in the event of unacceptable user behaviour, attempts to misuse others’ accounts, attempts to gain access to others’ data or other illegal or indecent conduct. If Kauza suspends or terminates your agreement to use WhatIBuy, Kauza will contact you via WhatIBuy or the email address you provided when creating your profile with WhatIBuy.
3. Upon deletion of your user profile, all the data registered on your user profile in WhatIBuy is permanently deleted or anonymised and cannot be restored. You may not bring any claim against Kauza if your account is deleted.
10. Withdrawal of consent
1. You may at any time withdraw one or more of the consents you have given in WhatIBuy. This may, for example, concern marketing emails, collection of your receipt information or similar. Withdrawal may take place at info@whatibuy.dk or in the WhatIBuy app.
2. If you withdraw one or more of your consents, you will still have access to your user profile in the WhatIBuy app, but certain features may no longer be available.
11. Liability
1. Kauza shall not be liable for your use of WhatIBuy, including, but not limited to, any acts or omissions based on information obtained through the WhatIBuy app. Your use of WhatIBuy and any information obtained through WhatIBuy is entirely at your own risk. Kauza does not warrant that use of WhatIBuy will produce any particular result and in particular assumes no liability for services provided or operated by third parties.
12. Changes
1. Kauza may revise or update this agreement by making an amended version available through the Service. If a change is material, Kauza will make you aware of the change, either through the Service and/or through contact details provided by you. Your continued use after such an update constitutes acceptance of the updated agreement. If you do not accept the update, you must stop using the Service.
13. Force majeure
1. Kauza cannot be held liable, directly or indirectly, in any way in the event of force majeure. Such force majeure events include, among other things, war, natural disasters, strikes, fires and other circumstances for which Kauza is not responsible. In the event of a force majeure event, performance under this agreement shall be suspended for the duration of the force majeure event. If the delay lasts for more than one month, both parties may terminate these terms of service without notice and without payment of compensation or damages to the other party.
14. Miscellaneous
1. The Service may contain links to third-party websites. Kauza does not endorse any website or services through the provision of such a link. Kauza therefore cannot be held liable in any way for such third parties or their use of information you provide when visiting their websites.
2. Kauza may assign its rights under this agreement, in whole or in part, to any person or entity at any time with or without your consent. You may not assign this agreement without Kauza’s prior written consent, and any unauthorised assignment by you will be void.
3. If any provision of this agreement is found to be illegal, invalid or unenforceable, this shall not affect the validity or enforceability of the remaining provisions.
15. Disputes
1. If you find any content abusive or infringing, you must immediately inform Kauza by sending an email to info@whatibuy.dk. The complaint must contain: i) a description of the content, ii) a description of where on the platform the content is located and iii) your contact details.
16. Governing law and venue
1. If a dispute cannot be resolved through the complaints process, it shall be decided by Copenhagen City Court. All disputes shall be governed by Danish law.
2. In the event of contradictions in different language versions of the agreement, the Danish version shall prevail.
17. Version
1. This is version 2 of Kauza’s terms of service dated 9 September 2022. This replaces all previously applicable terms. The terms remain in force until new terms are issued.
